Cake & Confections Contract

This contract is an agreement between Copper Cakes by Amanda, referred to as Copper Cakes, bakery, and creator, and you as the customer, referred to as customer, you, and contact.

Delivery

Delivery is scheduled and confirmed the week of the event, and will normally be approximately two (2) hours prior to the event start time or within venue time requests. 

  • Accidents/Weather – While we take our responsibilities very seriously, there may be some extreme conditions, such as accidents or inclement weather, which may prevent us from fulfilling our obligation. Please keep your contact information and alternate contacts up to date so that we may notify you of any situation that may have occurred or may be anticipated. With good communication, there is a much better chance of working out a reasonable solution to any situation.
  • If you want us to set up and decorate the cake table for you, please let us know in advance as we may need to bring special tools, equipment, etc. 
  • The table for the cake should be sturdy and level and not in a high traffic area for your event. Copper Cakes is not responsible for the integrity of the table that is provided for the cake to rest upon or the location where the table is placed. We will do our best to work with the event staff on the day of the event if there is a perceived problem, but are not liable for the table and items provided by another person/company.
  • It is your responsibility or the responsibility of the person you have designated to check the cake upon delivery. Once the delivery person leaves your premises, there will be no refunds. 
  • We are not responsible for how the cake is handled after delivery, where you place it, or what you do with it once it is out of our hands, this includes it being moved by yourself or the event staff. Cakes should not be outside and any ambient temperature higher than 75℉ can change the integrity of the cake and frosting. Keep the cake out of direct sunlight at all times.
  • Upon delivery and after the setup is complete, the care and protection of the cake becomes your responsibility.
  • Because of the way fresh flowers are handled, fertilized, and kept free of pests, they are not a truly edible ingredient in most cases. If you desire to have fresh flowers on your cake Copper Cakes does not take responsibility for any cross-contamination that may occur. We recommend all of our customers utilize sugar flowers for their cakes. 
  • If you would like Copper Cakes to place the flowers on your cake, please notify us at the time of your initial consultation so that we are prepared with the supplies needed at the time of delivery.

Customer Pick Up

  • It is your responsibility or the responsibility of the person you have designated to check the cake upon pick up. Once the cake leaves our premises, there will be no refunds. We are not responsible for how it is handled, where you place it, or what you do with it once it is out of our hands.
  • Cakes need to be picked up by the customer or their designated person during the agreed upon pick up window. If cakes are not picked up during the window and Copper Cakes has not heard from the customer, we reserve the right to sell it to another customer or donate it to a charitable organization. 
  • Our bakery will not be responsible for damages to your cake once it leaves our facility. Cakes should not be outside and any ambient temperature higher than 75℉ can change the integrity of the cake and frosting. Cakes must be kept out of direct sunlight at all times.

Payment Deadline Notice

  • To secure your date, a 25% non-refundable deposit will be required within five (5) days of receipt of the written estimate. This is a non-refundable deposit and will be applied to the order total.
  • If you would like to pay in increments, please let us know during your initial consultation so that we can create a payment plan for you, at no extra cost.
  • The final payment deadline is five (5) days prior to the date of delivery/pick up. 
  • If payment of final balance has not been received by the payment deadline, we reserve the right to terminate the agreement. In such an event, we will have no further obligation hereunder and any deposits made to date will not be refunded.

Order Changes

  • Reasonable changes to your order may be made up to one (1) week prior to the event.
  • Additional costs may be incurred depending on the nature of the changes and will be agreed upon by Copper Cakes and the customer. Additional costs must be approved in writing by both parties. 
  • Only persons specifically listed in the order are allowed to request a change. Final approval for a change is left to the primary customer, if they do not approve of the change, it will not be executed.

Cancellation

  • If you notify us of a cancellation prior to four (4) weeks before the event, we will refund any payments received above the 25% non-refundable deposit. Special conditions may exist that would allow the non-refundable deposit to be returned, but that is left to the discretion of Copper Cakes. 
  • If you notify us of a cancellation less than four (4) weeks before the event, you will be required to pay 50% of the cake’s original cost. 
  • If you notify us of a cancellation less than five (5) days prior to the event, you will be required to pay 75% of the original cake’s cost.
  • We understand that life is unpredictable and there may be unforeseen circumstances that may affect your event. It is the customer’s responsibility to communicate with Copper Cakes as soon as possible to make a cancellation. Copper Cakes reserves the right to make exceptions to our cancellation policy on a case-by-case basis.

Our Obligation

  • We take our obligation to provide your cake as agreed in this contract very seriously. However, should an unforeseeable event occur which prevents us from fulfilling our obligation and we must cancel our agreement with you, we will refund your payment in-full. In addition, if at all possible we will work with you to find another qualified bakery to assist you with your wedding cake and will cooperate in transferring materials to the new bakery.
  • While we make every effort to provide the exact flavors, fillings, decorations, sizes, shapes and colors you have requested, the creation of a cake is an art and may be subject to slight variations and/or errors by the creator(s). We will do what is reasonable to fix any error or accommodate the customer within reason.
  • Because cakes are an art form, it is unlikely that the cake will be identical to any image provided. Copper Cakes will make every effort to provide you with an appealing cake that is close to your design and vision, but we can not guarantee any exact match.

Photographs of Your Cake

  • We reserve the right to take and use our own photos of your cake(s) to use for marketing and promotional purposes, including advertising and promotion through our marketing partners, without compensation to you. 
  • We may also request photographs from your photographer for the same purpose again without compensation to you, though we may be able to credit the photographer in some marketing if agreed by us and the photographer.
  • You are welcome to share photos of your cake, but we ask that if you want to use one of our photographs, you must give credit to our business through one of our social media pages.

Allergens & Food Sensitivities

We make every attempt to prepare our cakes in a sterile environment, but because there are allergens present in our kitchen, we cannot guarantee that our goods are allergen free. If there are severe allergies that you are aware of, please notify us during your initial consultation.

Cake Construction

  • All tiered cakes will have dowels or supports inside of them. Copper Cakes is not liable for injuries caused by reckless behavior, included but not limited to smashing someone’s face into the cake. 
  • Cakes are often heavier than people expect them to be, because of this it is not recommended that anyone move the cake after it has been set up. 
  • Copper Cakes prepares food in a home kitchen and is not inspected by the Department of State Health Services or a local health department.

Refunds are provided if:

  • We fail to deliver or if we fail to have your cake ready for pick up on the date specified at the time frame as expected, not including events of Mother Nature that may prevent delivery until a later date/time. 
  • Should an unforeseeable event occur which prevents us from fulfilling our obligation and we must cancel our agreement with you, we will refund your payment in-full. 
  • Copper Cakes reserves the right to determine refunds on a case-by-case basis.

We do not provide refunds if:

  • The customer or someone ordering for them gives us the wrong date, address for delivery, or time.
  • We are not responsible for any additional expenses that you may receive because of incorrect information being provided to Copper Cakes, including but not limited to the wrong date, address, or time given.
  • Refunds requested due to style, decorations, color/shade/tint, size of decorations or misunderstanding about the design, misunderstanding of the overall general design concept, ordering a flavor you didn’t like or failure to order what you actually wanted, imperfections caused by weather, heat, humidity, rain, ice, freezing, snow or other factors beyond our control will not be honored.

In the unlikely event that you perceive a problem with the order and wish to raise a complaint, please do so as soon as possible, but no later than 24 hours after delivery/pick-up. Please note that any disputed portion of the order should be returned as soon as is appropriate after the event to facilitate investigation.

By accepting your estimate and paying your non-refundable deposit, you agree to the terms of this contract.
